Criminal Case - possession of a firearm by a felon. Defendant's
claims that the federal prosecution violated his Fifth and Sixth
Amendment rights are rejected, as prosecution was not based
on impermissible factors or as punishment for exercising a
legal right and former counsel did not supply prosecution with
information about defendant's knowledge of drug activities.
District court did not err in not suppressing information based
on Miranda and did not abuse its discretion in denying an
evidentiary hearing. The prior state attempted burglary conviction
was properly considered a crime of violence.
