Criminal Case - interlocutory appeal. Defendants challenge as
violating double jeopardy an indictment charging conspiracy
to commit mail fraud and wire fraud and to assist in the
unauthorized reception of cable television services following
conviction for unauthorized reception of cable television services.
Appeal is dismissed for lack of jurisdiction because defendants
do not raise a colorable claim of double jeopardy, as defendants
were sentence within statutorily authorized range for the previous
conviction and the totality of the circumstances do not suggest
that there was only a single conspiracy.
