U.S. Court of Appeals Case No: 01-1302
Northern District of Iowa
Civil case - contracts. Under Iowa law, it was not error to
submit both a breach of contract claim and a fraud claim
to the jury; the evidence was sufficient to support a plaintiff's
verdict on the claim for fraudulent nondisclosure as defendant's
fraudulent nondisclosure of a secret deal induced plaintiff to
ship certain samples which defendant needed in order to
close the deal; lost profits were recoverable under Iowa law;
evidence supported the jury's damage awards; fraud verdict
provided a basis for an award of punitive damages.
