Civil case - Immigration. Section 241(a)(5) of the Immigration
and Nationality Act, enacted as part of the Illegal Immigration
Reform and Immigrant Responsibility Act of 1996, may be
applied to expedite all reinstatement proceedings commenced
prior to enactment of the section, but the substantive defenses
to removal eliminated by the section may not be retroactively
denied to aliens who illegally reentered the U.S. prior to
enactment; removal order vacated and case remanded for
further proceedings.
