Civil case - civil rights. The court en banc finds that plaintiff
cannot establish that his federal right to be free of racial
discrimination was violated when he was not promoted to
the position of dean of industrial technology and workforce
development at Phillips Community College of the University
of Arkansas, as plaintiff was notified of the job opening and
failed to apply; District Court erred in denying Chancellor's
motion for qualified immunity on the claim, and the other
defendants were entitled to summary judgment on the merits.
Dissent by Judge Heaney, joined by Judge McMillian,
Judge Murphy and Judge Smith.

Civil case - civil rights. A reasonable jury could conclude that the
subjective manner in which the University filled administrative positions
is direct evidence of discriminatory practices, and the district court
did not err in finding plaintiff had made a prima facie case that
defendants' failure to promote him was discriminatory; in light of
ambiguity surrounding the University's promotion policies and
practices, defendants were not entitled to summary judgment on basis
of qualified immunity; dissent by Judge Morris S. Arnold.
