U.S. Court of Appeals Case No: 01-1843
Eastern District of Missouri
Prisoner case - prisoner civil rights. Prison unit manager was
entitled to qualified immunity on prisoner's claim that prison
officials failed to protect him from an assault by two fellow
inmates, including his cellmate; inmate's letter to staff
indicated he did not fear for his safety, and the letter failed
to provide a sufficient basis to conclude manager had
actual knowledge of a threat of serious harm to the prisoner;
nor did the manager have any knowledge that the assailants
had a propensity for violence; finally, the manager acted in
an objectively reasonable manner, including calling for a
search of the inmate's cell and interviews.
