Prisoner case - habeas. For AEDPA limitations period purposes,
petitioner's state court application for post-conviction review remained
pending during the period of time he had in which to file an appeal from
the state court order denying relief, even though he did not file such an
appeal; as a result, the district court erred in excluding this period of
time in determining whether petitioner's habeas petition was timely
under AEDPA; case remanded for further proceedings.
