011986P.pdf 01/10/2002 United States v. Arthur Lee Burns Jr.
U.S. Court of Appeals Case No: 01-1986
   Western District of Missouri
Criminal case - direct criminal appeal. Conviction for conspiring to commit credit card fraud and sentence are affirmed. Admission of defendant's silence during post-arrest interrogation after he signed Miranda waiver is not a violation of constitutional rights, and even it was error, the error was harmless beyond a reasonable doubt. Any error in admitting witness statements was harmless. District court did not err in calculating loss and in concluding there was only one conspiracy.
