Civil case - ERISA. Under the plan in question, once a
long-term disability benefits claim was made, the plan's
administrative committee was obligated to determine the
claimant's ability to work and whether or not he was in fact
working; here, the committee's failure to make that decision
constituted an abuse of discretion; case remanded for a
determination of whether plaintiff was in fact gainfully
employed during the period he claimed to be disabled.
