U.S. Court of Appeals Case No: 01-3065
District of Minnesota
Civil Case - employment discrimination. District court's grant
of summary judgment to employer on race discrimination
claims are affirmed. Claims from 1988 are time-barred; hostile
work environment claim failed because co-worker's misconduct
was neither severe nor pervasive enough and employer
responded when harassment was brought to management's
attention; employee did not show he was treated dissimilarly;
and retaliation claim failed because employee failed to show
adverse employment action.
