U.S. Court of Appeals Case No: 01-3078
Southern District of Iowa
Habeas Corpus - ineffective assistance of counsel. Grant of writ
because state court's finding of no prejudice was an unreasonable
application of federal law is reversed. The state's finding of no
prejudice in counsel's failure to object to admission of
codefendant's confession with reference to the existence of
another person (who could be the defendant), was not an
unreasonable application of federal law. Dissent by Judge Bright.
