U.S. Court of Appeals Case No: 01-3146
Southern District of Iowa
Civil Case - social security. Decision to deny claimant disability
insurance benefits is supported by substantial evidence. Where
contemporaneous treatment records conflict with physician's opinion
letter, substantial evidence supports decision not to give controlling weight
to opinion letter; some medical evidence must support opinion. ALJ did
not err in giving credence only to subjective complaints that were consistent
with objective medical evidence. Remand for consideration of new evidence '
is not appropriate where there is no reasonable probability that ALJ's
decision would have been different if evidence were before ALJ.
