Civil Case - Family and Medical Leave Act. Jury verdict in favor of employer is affirmed. Jury verdict is not against weight of evidence that employee did not request FMLA leave, that the employer's notice was not insufficient, or that the employee's waiver of FMLA was volitional. District court did not abused its discretion in refusing employee's jury instruction because instruction asked for district court to engage in inappropriate fact finding.
