U.S. Court of Appeals Case No: 01-3519
Eastern District of Missouri
Civil case - Torts. Case remanded for further proceedings
on the validity of the release plaintiff signed at the sale of
the dealership, as the evidence regarding consideration is
contradictory; district court erred in dismissing plaintiff's
claim under the Missouri Vehicle Franchise Practices Act;
district court erred in granting defendant's motion for
summary judgment on plaintiff's claim that GM's actions
in allocating vehicles breached its duty of good faith and
fair dealing as there is a genuine issue of material fact as
to whether GM exercised its discretion in good faith.
