Civil Case - employment discrimination. Failure to carry burden of production should result in judgment under Fed. R. Civ. P. 52(c), not Rule 52(a). District court's findings that other employee's actions did not compare to plaintiff's insubordination were not clearly erroneous and thus district court did not erred in ruling plaintiff failed to satisfy his productive burden.
