U.S. Court of Appeals Case No: 01-3685
and No: 02-1361
Eastern District of Missouri
Habeas Corpus - Death penalty. District court's conditional
grant of habeas corpus, to become permanent unless the state
permits defendant to withdraw his guilty plea and have a trial,
and the district court's denial of other claims unlawful use
of confession, ineffective assistance of counsel, and due
process violations are affirmed. State court's conclusion
that the extremely limited exchanges at which defendant waived
right to trial, right to counsel, and allowed prosecutor to
proceeding immediately to the penalty phase were adequate was
not a reasonable application of clearly established federal law.
State court also failed to consider impact of defendant's mental health.
