Civil case - False Claims Act. District court did not err in granting summary judgment on False Claims Act claims, as plaintiff failed to produce evidence raising a genuine issue of material fact as to whether the information allegedly withheld from the EPA was even relevant to the agency's decision to pay the contractor; further, the record established that EPA was aware of the problems and that the contractor worked closely with the EPA to resolve them, thus negating the required scienter for a False Claims Act action; with respect to certain claims that monitoring devices were tampered with, plaintiff failed to plead those claims with the required particularity, and the district court did not err in dismissing them.
