Civil case - False Claims Act. All of the false claims allegations
in plaintiff's complaint were based on information publicly
disclosed in Minnesota Department of Human Services
reports; plaintiff was the original source of some of the
publicly disclosed information, and one of his False Claims
Act qui tam claims was not barred by Section 3730(e)(4)(A)
of the act; there was sufficient evidence to support the jury's
verdict that defendant violated the False Claims Act by claiming
employee gift apples as a reimbursable Medicaid expense; court
reduces the number of false claims and the penalty imposed
under the Act from $1.6 million to $80,000.
