U.S. Court of Appeals Case No: 01-3984
and No: 02-3635
Western District of Missouri
Labor law - arbitration. District court's enforcement of arbitrator's
award is affirmed. Employer who failed to participate in arbitration but
filed motion to vacate the decision preserved and raised the substantive
jurisdictional challenge. Employer was under a court-directed obligation
to arbitrate. Arbitration decision is affirmed. District court's imposition
of discovery sanctions and to impose alter ego liability was not an abuse
of discretion. The district court did not abuse its discretion in failing to
consider an untimely filed motion to reconsider. [PUBLISHED] [Melloy,
