U.S. Court of Appeals Case No: 01-3990
Southern District of Iowa
Habeas case - ineffective assistance of counsel. District court's
denial of habeas relief based on claim counsel was ineffective
for allowing the introduction of evidence pertaining to
defendant's invocation of the right to remain silent and speak
with an attorney is affirmed. Defendant failed to
demonstrate prejudice and the state court's decision was
neither contrary to nor involved in an unreasonable application
of clearly established federal law.
