Bankruptcy Appellate Panel. Trustee failed in his burden of
proving that debtor corporation had a right to receive certain
insurance commissions and that its assignment of this right
to appellee was a wrongful transfer; the trustee's claim,
however, was not frivolous and the bankruptcy court erred
in imposing attorneys' fees against the trustee as a sanction
for bringing a frivolous action.
