Bankruptcy Appellate Panel. Under the Eighth Circuit's opinion in Four B. Corp. v. Food Barn, 107 F.3d 558 (8th Cir. 1997), bankruptcy court did not abuse its discretion in rejecting a bid obtained through a non-judicially approved bid procedure developed by a broker; court could reject bid and conduct a judicial auction even though Brink had signed a contract with the debtor based on the broker's bid process, as the contract was clearly subject to subsequent judicial approval.
