U.S. Court of Appeals Case No: 01-6086
Western District of Missouri
Bankruptcy Appellate Panel. Under the Eighth Circuit's opinion
in Four B. Corp. v. Food Barn, 107 F.3d 558 (8th Cir. 1997),
bankruptcy court did not abuse its discretion in rejecting a
bid obtained through a non-judicially approved bid procedure
developed by a broker; court could reject bid and conduct a
judicial auction even though Brink had signed a contract
with the debtor based on the broker's bid process, as the
contract was clearly subject to subsequent judicial approval.
