U.S. Court of Appeals Case No: 02-1036
Northern District of Iowa
Criminal case - criminal law. District court did not abuse its
discretion in admitting evidence concerning possession of
firearms in drug prosecution; use of special interrogatory
concerning drug quantity was not error; district court did
not err in denying motion for new trial based on claims
government's witnesses perjured themselves; evidence
was sufficient to support drug convictions; claims of
ineffective assistance of counsel were premature and
should be raised in a Section 2255 habeas petition; court
did not err in imposing two level enhancement for
possession of a firearm as it was not clearly improbable
that the gun was connected with the drug offense; dissent
by Judge Heaney on the enhancement issue.
