U.S. Court of Appeals Case No: 02-1054
District of North Dakota
Criminal case - criminal law. Evidence was sufficient to
support voluntary manslaughter conviction; prosecutor's
comment on defendant's failure to produce the shoes he
was wearing when he fatally kicked the victim was not
a comment on defendant's decision to exercise his Fifth
Amendment right against self-incrimination; when a
defendant suggests the government failed to produce
physical evidence it is reasonable for the government
to note in its closing argument defendant's testimony
that the evidence was in his possession.
