Criminal case - Sentencing Guidelines. A district court must
apply the guideline in place at the time the crime was
committed if application of the guideline in effect at the
time of sentencing would result in a more severe sentence;
here, sentence imposed would be same under either guideline,
so application of the guideline in place at the time of sentencing
did not result in an increased sentence or an the Ex Post Facto
Clause violation.
