U.S. Court of Appeals Case No: 02-1261
   District of Minnesota
Civil case - Individuals with Disabilities Education Act. District court did not err in finding that defendant provided plaintiff a free, appropriate third grade education, and that it was not obligated to provide plaintiff's mother with tuition reimbursement; in making these decisions, the district court properly relied on the plaintiff's educational progress and the continual evaluation process defendants provided. Dissent by Judge Bye.
