Criminal case - criminal law. Defendants' towbarge was a vessel for
purposes of the Clean Water Act, since it was a towable vehicle capable
of use as a means of transportation on the water; as a result, defendants
could not be criminally prosecuted for discharge of raw sewage from the
towbarge since the Act exempts the discharge of sewage from vessels.
