U.S. Court of Appeals Case No: 02-1323
Southern District of Iowa
Civil case - torts. District court did not err in finding Iowa
courts would adopt the 1998 revisions to Section 142 of
the Restatement (Second) of Conflict of Laws; applying
this standard, the district court did not err in determining
Illinois had the more significant relationship with the parties
and the occurrence and that Illinois's two-year statute of
limitations should apply to the plaintiff's legal malpractice
claims; applying the Illinois statute, the claims were
time-barred because the plaintiffs knew or reasonably
should have known of their claims more than two years
before this action was filed.
