Civil case - torts. Recusal claim may be considered even though
it was first raised in the appeal; since none of the bases for the
recusal were disclosed on the record, court could not say
plaintiffs had waived their right to raise the claim on appeal;
however, even assuming the statements provided in support
of recusal are true, they established no more than a mere
social relationship between the judge and a non-party fact
witness and do not require recusal; district court did not
err in granting summary judgment as plaintiff failed to
establish a causal link between their alleged injuries and
defendant's cathodic protection system.
