U.S. Court of Appeals Case No: 02-1515
District of Minnesota
Civil case - contracts. District court did not err in finding
statute of frauds barred breach of contract claim in dispute
concerning sale of a $200,00 boat; for purposes of the doctrine
of partial performance, boat and its navigational software were
not a single commercial unit, and transfer of software did not
constitute partial performance of the alleged sales contract;
nor would the software transfer papers constitute a sufficient
writing to satisfy the statute of frauds; district court did not err
in rejecting promissory estoppel argument.
