Civil Case - ERISA. District court's determination that employees'
state law claims were preempted by ERISA was error and district court
is instructed to remand case to state court. Former employees of Ceridian's
Technology Center sought to recover severance pay and compensation for
days off based on promise Ceridian gave to employees to pay these
benefits should they be terminated from Ceridian's successor. Promise
does not constitute an ERISA plan and did not amend the plan; thus there
is no federal subject matter jurisdiction.
