   protection. Upon de novo review, DOT regulations are narrowly 
   tailored, have substantial flexibility, are tailored to relevant labor 
   markets, and minimize the race-based nature. Program as applied by 
   Minnesota and Nebraska also serve a compelling government interest 
   and are narrowly tailored.
