Civil case - Home Investment Partnership Act. Non-profit
corporation established by the Cheyenne River Sioux Tribe had
standing to challenge defendant's denial of the corporation's request
for tax credits; however, the claims were barred by the applicable
statute of limitations; corporation also had standing to pursue
discrimination claims under the Home Investment Partnership Act and
the Fair Housing Act; however, the corporation failed to make a prima
facie case of discrimination as it could not establish that defendants
awarded funds to similarly-situated applications; corporation also
failed to establish its claim that defendants' operation of the program
had a disparate impact on it. Judge Hansen concurring.
