District court did not err in granting summary judgment on health maintenance organizations' damages claim under Minnesota misrepresentation statutes, as the groups did not make out a submissible case on the issue of damages; district court did not abuse its discretion in performing its gatekeeper function under Daubert when it excluded the testimony of the organizations' damages expert; case remanded for further proceedings on the organizations' claims for injunctive relief. Dissent by Judge Hansen.
