U.S. Court of Appeals Case No: 02-1692
District of Minnesota
Civil Case - breach of licensing contract. District court lacked
jurisdiction to enforce settlement order because dismissal order
did not incorporate the terms of the settlement, and court retained
jurisdiction to enforce the settlement only for 90 days and request
to enforce agreement was filed after 90-day period. Even if court
had jurisdiction to open case sua sponte under Rule 60(b), court
lacks authority to enforce terms of settlement agreement not
incorporated into court order. Dismissal order is reinstated.
