Criminal Case - sentencing.
District court's grant of upward departure is affirmed, as past
criminal conduct and significant interruption of
government function were permissible grounds. Defendant waived his
right to appeal the government's breach of the plea agreement by not
objecting to the government silence at sentencing when it had agreed to
recommend a sentence at the lower end of the guideline range in the
plea agreement.
