U.S. Court of Appeals Case No: 02-1740
Western District of Missouri
Civil case - civil rights. In trial for damages after defendants admitted
liability for the crash which killed plaintiff's son, district court's
admission of unredacted autopsy report did not result in a miscarriage
of justice; plaintiff's counsel's closing arguments did not require a new
trial; service of demand letter on defendant's insurer was service on
its representative for purposes of Mo. Rev. Stat. Sec. 408.040 and the
district court did not err in applying that statute and awarding
prejudgment interest; dissent by Judge Beam on the prejudgment
interest issue.
