both the terms of the parties' agreement and the provisions
of the statute of frauds barred enforcement of an alleged oral
agreement to reduce the amount Wal-Mart owed plaintiff;
district court did not err in finding as a matter of law that
none of Wal-Mart's e-mails on the issue constituted a
confirmation of an oral agreement sufficient to satisfy the
statute of frauds; district court did not err in denying plaintiff's
application for attorneys' fees.
