District court erred in granting defendant prosecutor absolute immunity as there was a genuine issue of material fact as to whether the prosecutor gave legal advice during an investigation of plaintiff; defendant police officers had probable cause to believe plaintiff had committed a drug crime, and plaintiff's arrest and prosecution did not constitute a substantive due process violation.
