U.S. Court of Appeals Case No: 02-2075
Western District of Missouri
Civil Case - diversity - real property. 1902 conveyance of land to
railroad for valuable consideration 50 feet on each side of railway
constituted a conveyance in fee simple absolute, not an easement, because
consideration was substantial and quantum of title conveyed was not
restricted. Thus, the grant of summary judgment to successor railroad on
claim by adjacent landowners for interest in land is affirmed.
