Civil case - Insurance. While the injury suffered by Modern
Equipment's customer constituted property damage within the meaning
of the commercial general liability policy issued by Continental, certain
losses were excluded under the policy, because the customer's losses
were due solely to the failure of Modern Equipment's rack system and
not from the loss of use of its warehouse, which remained otherwise
functional, and such losses were excluded from coverage.
