U.S. Court of Appeals Case No: 02-2285
Eastern District of Missouri
Civil case - insurance. Under Missouri law, an insurer may avoid a
contract of insurance if the person requesting issuance of the policy
failed to disclose he is acting as an agent for the party with the
insurable interest; here, there is a genuine issue of material fact
as to whether the party taking out the policy disclosed the agency
relationship to the insurance agent, and the district court erred
in granting the insurance company's motion for summary judgment.
