assisting in the filing of false income tax returns;
instruction cured any prejudice from admission of testimony
about acts outside the period of the conspiracy alleged in

government's closing argument did not require a new
trial; district court did not err in admitting evidence of
prior civil adjudications arising out of defendant's past
provision of tax services as it was relevant to his intent,
knowledge and motive; indictment was not defective; district
court did not err in imposing an upward enhancement based
on its belief defendant's criminal history score did not
adequately reflect the seriousness of his past conduct.
