Civil case - civil rights. Plaintiff failed to show stated reasons
for promotion of a male co-worker, his greater experience and
professional certification, were pretexts for gender discrimination;
district court erred in analyzing disparate pay claim as a statutory
claim under the Equal Pay Act and should have analyzed the
constitutional claim under the McDonnell Douglas/Burdine
framework; applying this analysis, plaintiff failed to show the
stated reasons for the pay disparities were pretexts for intentional
discrimination; district court erred in denying defendants' motion
for summary judgment on plaintiff's hostile work environment
claims, as the evidence she relied on did not establish that the
conditions she complained of were so severe or pervasive as to
alter a term or condition of her employment; evidence failed to
establish her supervisor was deliberately indifferent to her
rights; co-worker had no supervisory control or authority over
plaintiff and was a private actor for Section 1983 purposes.
