Civil Case - constitutionality of state statute. District court's
declaration that Mo. Rev. Stat. sec. 323.060.1 is
unconstitutional because it burdens interstate commerce and
provides minimal local benefit is affirmed. Requiring
persons engaged in bulk sale to propane to maintain and
operate minimum storage capacity of 18,000 gallons is not
overtly discriminatory but the local benefit actually derived
from the statute is minimal or nonexistent and thus is burdensome.
