Criminal case - criminal law. Conviction and death sentence of a
member of the Aryans Peoples' Republic affirmed. Hearsay statements
made by nontesifying codefendant were not testimonial and were
admissible under Crawford v. Washington, 124 S.Ct. 1354; district court
did not err in refusing to give defendant's proposed instruction on
accomplice testimony, as the testimony had been corroborated; no error in
denying motion to sever trial from codefendant's; evidence at trial was
sufficient to support conviction for criminal enterprise and conspiracy;
constitutional challenge to Federal Death Penalty Act rejected; allegations
of trial error rejected; claim of ineffective assistance of counsel based on
allegations that defendant's lead counsel had a conflict of interest should
be brought in a habeas action.
