Civil case - civil rights. Viewing the evidence in the light most favorable to the EEOC, the proximity of an employee's complaint of discrimination to his discharge, coupled with the employer's inconsistent enforcement of its policies and use of disciplinary sanctions, established facts from which a reasonable jury could draw the conclusion that the employer retaliated against the employee for filing an EEOC complaint, and the district court erred in setting aside the EEOC's jury verdict and granting the employer judgment as a matter of law. Judge Riley dissenting.
