U.S. Court of Appeals Case No: 02-2694
and No: 02-2748
Western District of Missouri
Criminal case - criminal law. Warrantless search of a home was
justified by officers' fears that other people were in the home
and posed a threat to them; district court did not err in
instructing the jury that, in order to convict defendants of
conspiracy or attempt, it must find that the violation of the law
involved the manufacture of 50 grams or more of a mixture
and substance of methamphetamine; evidence was sufficient to
support conviction for possession with intent to distribute as
amount seized, while small, was divided into individual
packages and the other evidence established defendant was
dealing in drugs with a number of customers; no error in
refusing to sever or in refusing to give proposed instruction
dealing with the credibility of cooperating witnesses.
