U.S. Court of Appeals Case No: 02-2770
Eastern District of Arkansas
Prisoner case - prisoner civil rights. Inmate's amended
complaint failed to satisfy the imminent-danger-of-serious-physical-injury
exception to 28 U.S.C. Sec. 1915(g) at the time he filed the
complaint; while the court would normally remand the
case to the district court to give the inmate an opportunity to
reinstate his case by paying the filing fees, here, the record
establishes the district court properly granted the defendants'
motion for summary judgment, and the judgment of the
district court is affirmed.
