U.S. Court of Appeals Case No: 02-2992
and No: 02-3147
and No: 02-2994
Eastern District of Missouri
Criminal case - criminal law. Warrants were supported by sufficient
evidence to establish probable cause; district court did not err in refusing
to convene a Franks hearing, as the affidavit submitted in support of the
warrant was truthful; Bruton claims rejected; government's comments in
closing argument were not an improper reference to defendant's decision
not to testify; in a charge of conspiracy, the government is not limited to
proof of the overt acts charged in the indictment, and a defendant may be
held responsible for any acts of the conspiracy; thus, the district court did
not err in sentencing defendant for five bank robberies when the overt acts
of the conspiracy indictment only listed his participation in two.
